1. Agreement to These Terms

These Terms of Service ("Terms") are a binding legal agreement between you and Beamo LLC ("Beamo," "we," "us," or "our"). They govern your access to and use of Beamo Search at beamosearch.com, including all pages, APIs, and features we operate under that domain, and related experiences such as our Capacitor-based mobile app shell and optional Beamo Search Helper browser extension that direct you to or interact with the website (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

We may offer additional guidelines, product descriptions, or help text on the site. If there is a conflict between those materials and these Terms, these Terms control unless we expressly state otherwise in writing.

2. Eligibility

You may use the Service only if:

• you are at least 13 years old (or the minimum age required in your jurisdiction to consent to use of online services, if higher);
• you have the legal capacity to enter into a binding contract, or you have verifiable parental or guardian consent where required by law; and
• you are not barred from using the Service under applicable law and have not been previously suspended or removed by us.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

3. Description of the Service

Beamo Search is an internet search and assistant experience. Depending on how you use it, the Service may:

• Search the web, images, or news by sending your queries from our servers to the Brave Search API and displaying results and related UI.
• Provide AI chat on the homepage and results page by sending your messages (and optional context such as your current search query or approximate location) from our servers to our AI providers (Google Cloud Vertex AI and OpenAI) and streaming replies back to your browser.
• Generate AI search summaries related to your query using those AI providers, based on search snippets and similar context we provide to the model.
• Support shortcuts such as math evaluation, weather-related answers using approximate coordinates, URL detection, and English word definitions via third-party dictionary services.
• Store session state such as chat history (up to the last 30 user/assistant messages per server session), theme preferences, and browser-side caches as described in our Privacy Policy.

We do not require you to create an account, pay a subscription fee, or sign in with a third-party identity provider to use the core Service. We may add, change, or remove features at any time. The Service does not include human review of every query or response before it is shown to you.

3.1 Optional accounts

You may create an optional free Beamo account — with an email and password, or by signing in with Google, Apple, or Microsoft — to sync your saved searches, recent history, chat, and preferences across devices. Authentication and account data are handled by our provider Supabase, as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account, and you agree to notify us promptly at beamo@beamosupport.com if you suspect unauthorized use. You may delete your account at any time from Your data.

3.2 Beamo Pro subscriptions

Beamo Pro is an optional paid subscription that unlocks features such as an ad-free experience, higher sync limits, and the "Deeper" AI answer tier. If you subscribe, the following terms apply:

• Billing through a third-party processor. Payments are processed by our merchant of record (Lemon Squeezy or Paddle, as configured) on its own hosted checkout, and your purchase is also subject to that processor's terms. We do not receive or store your full payment card or bank details.
• Recurring, auto-renewing subscription. Unless stated otherwise at checkout, Beamo Pro renews automatically at the end of each billing period (for example, monthly or annually) at the then-current price, using your payment method on file, until you cancel.
• Cancellation. You may cancel at any time from the billing portal linked in your account settings. Cancellation stops future renewals; your Pro access continues through the end of the current paid period, and you will not be charged again after that.
• Price and feature changes. We may change Pro pricing or features. We will give notice of a price increase before it applies to your next renewal; continuing the subscription after the change takes effect is acceptance, and you may cancel if you do not agree.
• Taxes. Listed prices may exclude taxes; the payment processor may collect applicable sales tax or VAT as the merchant of record.
• Refunds. Except where required by applicable law (including any mandatory consumer or EU/UK withdrawal rights), payments are non-refundable and partial periods are not pro-rated. Refund requests are handled under the payment processor's policy; contact beamo@beamosupport.com for help.
• Free tier remains. Core search and the basic AI Overview stay free; you are never required to subscribe to use the Service.

4. No Professional Advice; AI Limitations

The Service is for general information and convenience only. Search results, AI chat replies, summaries, and other generated content may be inaccurate, incomplete, outdated, biased, or inappropriate. You must not rely on the Service as a substitute for professional advice (including medical, legal, financial, tax, safety, or mental-health advice) or for decisions that could cause harm if wrong.

You are solely responsible for evaluating output and for any actions you take based on it. When stakes are high, consult qualified professionals and verify information from authoritative sources.

We do not guarantee that AI output will be unique, non-infringing, or suitable for publication or commercial use. You assume all risk arising from your use or redistribution of output.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not, and must not attempt to:

• violate any applicable law, regulation, or third-party rights (including privacy, publicity, intellectual property, or contractual rights);
• harass, threaten, defame, abuse, or harm others, or promote violence, discrimination, or illegal activity;
• submit content that is unlawful, sexually exploitative (especially involving minors), or that facilitates serious wrongdoing;
• probe, scan, or test the vulnerability of our systems or networks, bypass rate limits, origin checks, or other security measures, or access non-public areas without authorization;
• use bots, scrapers, or automated means to access the Service in a manner that burdens our infrastructure or circumvents normal browser use, except as allowed by robots.txt or our prior written consent;
• reverse engineer, decompile, or extract source code from the Service except to the limited extent expressly permitted by applicable law notwithstanding this restriction;
• resell, sublicense, or commercially exploit the Service or access to it without our written permission;
• impersonate Beamo, our personnel, or any other person or entity, or misrepresent your affiliation;
• send malware, spam, or deceptive queries designed to manipulate models, exfiltrate data, or attack third parties; or
• encourage or assist anyone else in any of the above.

We may use automated and manual means to enforce acceptable use, including rate limiting, blocking requests, clearing sessions, and cooperating with law enforcement where required.

6. Your Content and License to Beamo

"Your Content" means search queries, chat messages, and other material you submit to the Service. You retain ownership of Your Content as between you and us, subject to rights of third parties (for example, if you paste someone else's copyrighted text).

You grant Beamo a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Your Content solely as necessary to operate, secure, improve, and provide the Service (including sending portions to Brave, Google, OpenAI, and other subprocessors described in our Privacy Policy). This license ends as to copies we are not required to retain when Your Content is deleted from active systems, subject to backup, legal, and safety retention limits.

You represent that you have all rights needed to submit Your Content and that doing so does not violate these Terms or applicable law.

7. Intellectual Property

The Service (excluding Your Content and third-party materials) is owned by Beamo and its licensors, including software, design, text, graphics, logos, and trademarks. Except for the limited rights expressly granted in these Terms, we reserve all rights. You may not use our name, logos, or branding without prior written permission.

Some open-source components used in or related to Beamo Search may be licensed separately (for example, under Creative Commons or other licenses noted in repository documentation). Those licenses govern the components they cover, not your right to use the hosted Service itself.

Search results and third-party websites linked from the Service are owned by their respective providers. Your use of those materials is subject to their terms and policies.

8. Third-Party Services and Links

The Service depends on and links to third parties, including without limitation Brave Search, Google (Vertex AI Gemma), OpenAI and Anthropic (AI), Supabase (authentication and account data), Google, Apple, and Microsoft (optional sign-in), Lemon Squeezy or Paddle (payment processing for Beamo Pro), ipinfo.io, dictionary APIs, travel and commerce partners linked from Settings, feedback forms (such as Typeform), and sites reachable through search results. We do not control and are not responsible for third-party services, content, or policies. Your dealings with third parties are solely between you and them.

When you leave beamosearch.com, different terms and privacy practices may apply. You should review the applicable policies before providing information or making purchases elsewhere.

Affiliate links. Some of Beamo's own links are affiliate links (including Amazon Associates, the eBay Partner Network, and Kiwi.com travel), and Beamo may earn a commission when you click them and purchase or book, at no extra cost to you. These links are disclosed and marked rel="sponsored", and they never alter the organic search results returned by Brave. See the Affiliate Links section of our Privacy Policy.

9. Browser Extension and Mobile App

The optional Beamo Search Helper extension and our mobile apps are interfaces to the same Service. The extension must open beamosearch.com in a normal browser tab (same origin, CSP, and session rules as a direct visit); it must not embed the Service in an extension frame or call our APIs from the extension origin. Clients must be used in compliance with these Terms, applicable app-store rules, and our technical requirements. We may update or discontinue those clients without liability.

Mobile apps load our website (or a configured home URL) in an embedded browser context; data handling is described in our Privacy Policy and is substantially the same as on the web.

10. Rate Limits, Availability, and Changes

We apply technical limits (including per-IP rate limits on search, chat, summary, and related endpoints) to protect the Service and manage costs. Limits may change without notice. We do not guarantee uninterrupted, error-free, or secure operation. Maintenance, outages, upstream API failures, and force majeure events may affect availability.

We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation except as expressly stated in these Terms.

11. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe material accessible through the Service infringes your copyright, send a notice to our designated agent with the information required by 17 U.S.C. § 512(c)(3), including:

• your physical or electronic signature;
• identification of the copyrighted work claimed to have been infringed;
• identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it;
• your contact information;
• a statement that you have a good-faith belief that use is not authorized; and
• a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.

Send DMCA notices to: beamo@beamosupport.com (subject line: "DMCA Notice"). We may remove or disable access to material and terminate repeat infringers where appropriate. Counter-notices must comply with applicable law.

12. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Service, you consent to those practices.

13. Feedback

If you submit ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation to you, except where prohibited by law.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, we do not warrant that the Service will meet your requirements, that results or AI output will be accurate or reliable, that defects will be corrected, or that the Service is free of harmful components.

Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, the above exclusions apply only to the extent permitted.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BEAMO, ITS MEMBERS, MANAGERS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (WHICH MAY BE ZERO IF YOU HAVE NOT PAID US).

Some jurisdictions do not allow limitation of incidental or consequential damages or caps on liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

16. Indemnification

You will defend, indemnify, and hold harmless Beamo and its members, managers, employees, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right. We may assume exclusive defense and control of any matter subject to indemnification at your expense, and you will cooperate with our defense.

17. Dispute Resolution; Governing Law

17.1 Informal resolution

Before filing a claim, you agree to contact us at beamo@beamosupport.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

17.2 Governing law and venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles that would require another jurisdiction's laws. Except where prohibited by law, you and Beamo consent to the exclusive jurisdiction and venue of the state and federal courts located in Davidson County, Tennessee, and waive any objection to inconvenient forum.

17.3 Time limit to bring claims

To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within one (1) year after the claim accrues; otherwise, the claim is permanently barred.

17.4 Class and representative actions

Where permitted by law, disputes will be resolved only on an individual basis. You and Beamo waive any right to participate in a class, collective, consolidated, or representative action or proceeding, except where such waiver is unenforceable.

18. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms, poses risk to us or others, or for any other reason. You may stop using the Service at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.

19. Export and Sanctions

You may not use or export the Service except as authorized by United States law and the laws of the jurisdiction in which you reside. You represent that you are not located in, under the control of, or a national or resident of any country or person subject to U.S. government embargo or sanctions lists.

20. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law.

21. General

• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Beamo regarding the Service and supersede prior agreements on that subject.
• Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Force majeure. We are not liable for delay or failure due to events beyond our reasonable control (including internet failures, upstream API outages, labor disputes, natural disasters, war, or government action).
• Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
• Electronic communications. You consent to receive communications from us electronically, including by posting notices on the Service or emailing the address you provide (if any).

22. California Residents

Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

23. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be highlighted on the Service where practicable. Your continued use after the effective date of revised Terms constitutes acceptance. If you do not agree, you must stop using the Service.
